How do you determine when "public safety" justifies abolishing Constitutional rights?

Well, the Courts have finely gotten smart and realized that if the Citizen is not going to be responsible enough to recognize that they have responsibilities towards society as much as they have rights within that society then they will have to step in, balance off collective (societal) rights versus individual rights. I see nowhere in any documents where it says individual rights are untouchable and supreme when compared to the overall rights of society.
